The laws of each state differ immensely. Some states prefer to award joint custody to the parents, while others will only do so when both parents agree to it. Other states do not have any special provisions created for joint custody. The states that prefer joint custody have even created special laws that help the family courts to reach a decision of joint custody. When the evidence and testimonies do not point towards joint custody, a child custody case can become very difficult to preside over. While some states already have legislation that tries to sway judges to rule for joint custody, many other states are trying to pass similar legislation.


The states that have this legislation rely on a judge to view evidence that is presented in order to determine if a parent is unfit to have custody of the child for some reason. There are many different reasons that a judge may declare a parent unfit for custody, best way to approach the child custody case. In most instances, if the child is of appropriate age, they can just speak to the judge. Their testimony alone will be enough to rule against another parent. Of course, it is not always that easy. For this reason, the previous recommendation of consulting a family lawyer is advantageous.
